Yarriambiack Heritage Review

1. Overview

Yarriambiack Shire Council is preparing the Yarriambiack Shire Heritage Review (the Review) as a part of the recommendation from the Yarriambiack Planning Scheme Review conducted in 2023.

The Yarriambiack Heritage Study was undertaken between 2012 to 2014 which included the preparation of a thematic history, 108 citations of individual places and 15 precinct citations, a local policy and a permit exemption Incorporated Document, and corrections to existing Heritage Overlay (HO) mapping errors. This work was a recommendation of the 2008 scheme review, however the study was not adopted by Council or implemented into the Yarriambiack Planning Scheme.

Due to the age of the study and new guidance on heritage places, the Department of Transport and Planning has recommended that a review of the study be undertaken, and further work completed to update citations, local policy and ordinance to ensure consistency with modern practice.

Council has engaged a heritage consultant to undertake the review.

2. What was is being proposed as a part of the heritage review?

Council is looking to review and implement the recommendations from the Yarriambiack Heritage Study (2014). Some key recommendations from that study include:

  • Adding the precincts assessed as being of local significance to the Heritage Overlay (HO) of the Yarriambiack Planning Scheme
  • Adding the places assessed as being of local significance to the HO of the Yarriambiack Planning Scheme.
  • Adding Lake Marma to the Significant Landscape Overlay and amend the existing HO38 that applies specifically to the Queen Victoria Rotunda, Sprott Fountain and War Memorial so that HO38 accurately applies to each feature and is extended to include the Scout Hall.
  • Adding a Heritage Places Incorporated Document which will set out permit exemptions
  • Correcting errors with the HO schedule and HO maps in relation to existing HO places

3. Why is Council carrying out a heritage review?

Council plays an important role in protecting the historically significant places within the municipality as required by the Planning and Environment Act (1987). 

The Review will ensure that all local heritage places have an up-to-date citation, which clearly explains what, how and why they are of heritage value. This will provide greater certainty for Council and property owners and managers and will support the development of heritage places without impacting upon heritage values.

4. Will heritage controls be applied to my property?

At this stage, no. When it is completed, the Review may identify places that require HO controls to be updated or changed (for example, to correct name or address errors).

However, this recommendation will need to be considered first by Council who must decide whether to proceed, which would require an amendment to the Yarriambiack Planning Scheme to change any heritage controls.

Until this happens, any current HO controls that apply to your property will not change.

5. Will I be able to have my say if a Heritage Overlay is proposed for my property?

Yes.  The planning scheme amendment process will provide the opportunity for all affected landowners or occupiers to make a formal submission to Council about the proposed heritage controls.  This may result in an independent panel hearing process if Council and the landowner, or the occupier, do not agree about the heritage controls being proposed for the site.
