Leasing of Council Land

Council may lease Council-owned land to individuals, community groups or commercial organisations where it supports community benefit, service delivery or strategic objectives.


Legislative Authority

The leasing of Council land is governed by section 115 of the Local Government Act 2020.  This section sets out Council's powers and obligations when entering into leases of Council-owned land.


Key Legislative Requirements

Under section 115 of the Act:

  • Council may lease land for a term of 50 years or less;
  • Certain lease proposals must be included in Council's annual budget, including:
    • Leases of one year or more where the rent or market rental value is $100,000 or more per year; or
    • Leases for a term of 10 years or more; and
  • Where a qualifying lease proposal was not included in the budget, Council must undertake a community engagement process in accordance with its Community Engagement Policy before entering into the lease.

How Council Considers Lease Proposals

When considering a proposal to lease Council land, Council takes into account:

  • The purpose and proposed use of land;
  • Community benefit and alignment with Council plans and strategies;
  • Financial and risk considerations;
  • Compliance with legislative and policy requirement, where required.
  • Any feedback received through community engagement, where required.

Leases may be granted on commercial or non-commercial terms, depending on the nature of the proposed use and Council's Leases and Licenses Policy.
