Asset Protection & Road Reserve Works Permit is required prior to the commencement of any building or construction works, including works that do not otherwise require a building permit.

Scope of Works

This permit applies to any works in connection with, but not limited to:

  • Construction
  • Renovation
  • Alteration
  • Demolition, relocation or removal of buildings
  • Landscaping and concreting works
  • Driveway crossovers
  • Stormwater drainage connections
  • Footpaths, nature strips and road construction

Purpose of the Permit

The permit protects the property owner and contractor from liability for damage to existing infrastructure assets that were in place prior to works commencing. Assets covered include infrastructure owned by Council, utility providers, and private entities, and generally comprise all areas outside the property boundary, including but not limited to:

  • Vehicle crossings
  • Footpaths and nature strips
  • Kerb and channel
  • Road pavement
  • Drains and pits
  • Trees
  • Signs, poles and hydrants

A pre-works inspection will be conducted to record the condition of these assets so that responsibility for pre-existing damage is clearly established.

Timing Requirements

The permit must be obtained at least 2 weeks prior to the intended start date of works to allow Council’s Technical Services Department to schedule a pre-commencement inspection.

Application Requirements

The following must be submitted as part of the application:

  • Public Liability Insurance
    • A copy of the contractor’s current Certificate of Currency is required before the application can be completed.
    • Minimum coverage:
      • $10 million for works within the road reserve
      • Some works may require coverage of up to $20 million, depending on scope and risk
  • Sketch Plan
    • A plan showing the proposed works and all assets in the vicinity, including trees, kerb and channel, road pavement, footpaths, drains, service authority assets and any private infrastructure

Insurance

Public Liability Insurance provides financial protection to both the public and those responsible for carrying out the works in the event of damage or injury to third parties or assets. To avoid processing delays, the Certificate of Currency should be submitted with the initial application.

Road Management Limitations

Council may only issue permits for works within the road reserve on Council-managed roads.
Council cannot issue permits for roads managed by other authorities, including:

  • VicRoads – 13 11 71
  • Parks Victoria – 13 19 63
  • DEECA – 03 5336 6856

Where works are proposed on roads managed by these agencies or on private roads, approval must be obtained directly from the relevant authority.
