Governance Rules (incl. Election Period Policy)

The Governance Rules regulate Council meetings, decision‑making processes, and Councillor conduct in accordance with section 60 of the Local Government Act 2020, ensuring transparency, fairness, and accountable governance. They outline procedures for Council and delegated committee meetings, public participation, notices of motion, urgent business, voting processes, and expectations of orderly and respectful behaviour.
 
The Governance Rules also include Council’s Election Period Policy, as required under section 69 of the Local Government Act 2020, which sets out how Council will manage its decision‑making, communications, and resources during the election period. The policy ensures that Council operations remain fair, transparent, and politically neutral by preventing inappropriate decisions, limiting public communications that may influence voters, and outlining expectations for Councillor conduct to maintain the integrity of the electoral process.

Local Law 2024 (incl. Local Law Guidelines)

The Local Law 2024 establishes rules designed to protect public order, community safety, neighbourhood amenity, and the environment. It also provides Council with the necessary enforcement powers to regulate local issues effectively.

The legislative authority for making and administering this local law is derived from section 71 the Local Government Act 2020, which empowers councils to create local laws to manage matters within their jurisdiction. Additional legislative frameworks referenced in the development and application of the local law include:

  • Environment Protection Act 2017: Which Council may rely upon for enforcement and regulatory authorisations where environmental matters are more appropriately addressed under state legislation.
  • Country Fire Authority Act 1958: Relevant when fire hazards or unsafe property conditions intersect with Council’s regulatory responsibilities.

The Local Law adopted by Council was formally enacted under section 74 of the Local Government Act 2020 and outlines objectives including protecting community safety, neighbourhood amenity, public assets, and the natural and built environment.

Registration of Swimming Pools and Spas Policy and Procedure

Return to Work Policy and Guidelines

The Return to Work Policy and Guidelines supports injured or unwell employees returning to work safely and gradually. It outlines responsibilities, processes, and support measures. This policy meets the legislated requirements under Part 4 of the Workplace Injury Rehabilitation and Compensation Act 2013, which sets out mandatory return‑to‑work obligations for employers, including providing suitable employment, planning and consulting on return‑to‑work arrangements, nominating a return‑to‑work coordinator, and making return‑to‑work information available to workers.
In addition, the policy aligns with the Occupational Health and Safety Act 2004, which requires employers to provide and maintain a working environment that is safe and without risks to health, so far as is reasonably practicable, including during injury recovery and return‑to‑work processes.

 

Risk Management Manual

The Risk Management Manual outlines Yarriambiack Shire Council’s organisation‑wide approach to identifying, assessing, and managing risks.
